Asimismo, de conformidad con lo previsto en el RGPD y la LOPD-GDD, salvo que sea de aplicaci\u00f3n la excepci\u00f3n prevista en el art\u00edculo 30.5 del RGPD, se mantiene un registro de actividades de tratamiento que especifica, seg\u00fan sus finalidades, las actividades de tratamiento llevadas a cabo y las dem\u00e1s circunstancias establecidas en el RGPD.<\/p>\n<h4>Principles applicable to the processing of personal data<\/h4>\n<p>The processing of the User's personal data shall be subject to the following principles contained in Article 5 of the RGPD and in Article 4 and following of the Organic Law 3\/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights:<\/p>\n<ul>\n<li>Principle of lawfulness, fairness and transparency: the consent of the User will be required at all times after fully transparent information of the purposes for which personal data are collected.<\/li>\n<li>Principle of purpose limitation: personal data will be collected for specified, explicit and legitimate purposes.<\/li>\n<li>Principle of data minimization: the personal data collected will be only those strictly necessary in relation to the purposes for which they are processed.<\/li>\n<li>Principle of accuracy: personal data must be accurate and always up to date.<\/li>\n<li>Principle of limitation of the storage period: personal data will only be kept in such a way as to allow the identification of the User for the time necessary for the purposes of their processing.<\/li>\n<li>Principle of integrity and confidentiality: personal data will be treated in a way that guarantees its security and confidentiality.<\/li>\n<li>Principle of proactive responsibility: the Controller shall be responsible for ensuring that the above principles are complied with.<\/li>\n<\/ul>\n<h4>Categories of personal data<\/h4>\n<p>Las categor\u00edas de datos que se tratan en&nbsp;Serverus Tech Solutions&nbsp;son \u00fanicamente datos identificativos. En ning\u00fan caso, se tratan categor\u00edas especiales de datos personales en el sentido del art\u00edculo 9 del RGPD.<\/p>\n<h4>Legal basis for the processing of personal data<\/h4>\n<p data-start=\"2976\" data-end=\"3090\">La base legal para el tratamiento de los datos personales depender\u00e1 del tipo de formulario y relaci\u00f3n establecida:<\/p>\n<ul data-start=\"3092\" data-end=\"3446\">\n<li data-start=\"3092\" data-end=\"3170\">\n<p data-start=\"3094\" data-end=\"3170\"><strong data-start=\"3094\" data-end=\"3127\">Consentimiento del interesado<\/strong> (art. data-end=\"828\">The personal data provided through the \u201cWork with us\u201d form or by voluntarily sending a curriculum vitae will be treated by <strong data-start=\"981\" data-end=\"5188\">Gestionar posibles colaboraciones profesionales.<\/p>\n<\/li>\n<li data-start=\"5189\" data-end=\"5256\">\n<p data-start=\"5191\" data-end=\"5256\">Asignar servicios, proyectos, guardias o coberturas operativas.<\/p>\n<\/li>\n<li data-start=\"5257\" data-end=\"5323\">\n<p data-start=\"5259\" data-end=\"5323\">Mantener una base de datos de proveedores activos o potenciales.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5325\" data-end=\"5494\">La base legal del tratamiento ser\u00e1 la <strong data-start=\"5363\" data-end=\"5405\">application of pre-contractual measures<\/strong> (art. 6.1.b RGPD) y, cuando proceda, el consentimiento del interesado (art. 6.1.a RGPD).<\/p>\n<p data-start=\"5496\" data-end=\"5612\">Los datos se conservar\u00e1n durante un per\u00edodo m\u00e1ximo de <strong data-start=\"5550\" data-end=\"5562\">18 months<\/strong>, o hasta que el interesado solicite su supresi\u00f3n.<\/p><p dir=\"ltr\"><strong>Tratamiento de datos para env\u00edo de newsletter<\/strong><\/p><p dir=\"ltr\">Los datos personales facilitados a trav\u00e9s de los formularios de suscripci\u00f3n a la newsletter de Serverus Tech Solutions ser\u00e1n tratados por <strong>Serverus Tech Solutions S.L.<\/strong> con la finalidad de remitir comunicaciones peri\u00f3dicas de car\u00e1cter informativo y comercial relacionadas con ciberseguridad, tecnolog\u00eda y servicios propios de la empresa.<\/p><p dir=\"ltr\">La base legal para este tratamiento es el <strong>consentimiento expreso del interesado<\/strong> (art. 6.1.a RGPD), prestado en el momento de la suscripci\u00f3n, en cumplimiento de lo dispuesto en el art\u00edculo 21 de la Ley 34\/2002, de Servicios de la Sociedad de la Informaci\u00f3n y de Comercio Electr\u00f3nico (LSSI-CE).<\/p><p dir=\"ltr\">Los datos se conservar\u00e1n mientras el interesado no revoque su consentimiento. El usuario podr\u00e1 darse de baja en cualquier momento a trav\u00e9s del enlace de cancelaci\u00f3n de suscripci\u00f3n incluido en cada comunicaci\u00f3n, o dirigiendo una solicitud a <strong>info @ serverus.es<\/strong>.<\/p><p data-start=\"5496\" data-end=\"5612\">\n\n\n\n<\/p><p dir=\"ltr\">Los datos no se ceder\u00e1n a terceros, salvo que act\u00faen como <strong>encargados del tratamiento<\/strong> bajo contrato conforme al RGPD (por ejemplo, la plataforma de env\u00edo de newsletter utilizada por Serverus Tech Solutions).<\/p>\n<h4>Retention periods of personal data<\/h4>\n<p>Los datos personales se conservar\u00e1n \u00fanicamente durante el tiempo necesario para cumplir con las finalidades para las que fueron recabados y, en todo caso, durante los plazos m\u00e1ximos indicados en esta pol\u00edtica.<\/p>\n<h4>Recipients of personal data<\/h4>\n<p data-start=\"5919\" data-end=\"5975\">Los datos personales no ser\u00e1n cedidos a terceros, salvo:<\/p>\n<ul data-start=\"5977\" data-end=\"6257\">\n<li data-start=\"5977\" data-end=\"5996\">\n<p data-start=\"5979\" data-end=\"5996\">Obligaci\u00f3n legal.<\/p>\n<\/li>\n<li data-start=\"5997\" data-end=\"6163\">\n<p data-start=\"5999\" data-end=\"6163\">Cuando resulte necesario para la correcta ejecuci\u00f3n de servicios profesionales solicitados por clientes, limit\u00e1ndose la cesi\u00f3n a los datos estrictamente necesarios.<\/p>\n<\/li>\n<li data-start=\"6164\" data-end=\"6257\">\n<p data-start=\"6166\" data-end=\"6257\">Cuando terceros act\u00faen como <strong data-start=\"6194\" data-end=\"6224\">encargados del tratamiento<\/strong>, bajo contrato conforme al RGPD.<\/p>\n<\/li>\n<\/ul>\n<h4>Personal data of minors<\/h4>\n<p>Respetando lo establecido en los art\u00edculos 8 del RGPD y 7 de la Ley Org\u00e1nica 3\/2018, de 5 de diciembre, de Protecci\u00f3n de Datos Personales y garant\u00eda de los derechos digitales, solo los mayores de 14 a\u00f1os podr\u00e1n otorgar su consentimiento para el tratamiento de sus datos personales de forma l\u00edcita por&nbsp;Serverus Tech Solutions. Si se trata de un menor de 14 a\u00f1os, ser\u00e1 necesario el consentimiento de los padres o tutores para el tratamiento, y este solo se considerar\u00e1 l\u00edcito en la medida en la que los mismos lo hayan autorizado.<\/p>\n<h4>Secrecy and security of personal data<\/h4>\n<p>Serverus Tech Solutions&nbsp;se compromete a adoptar las medidas t\u00e9cnicas y organizativas necesarias, seg\u00fan el nivel de seguridad adecuado al riesgo de los datos recogidos, de forma que se garantice la seguridad de los datos de car\u00e1cter personal y se evite la destrucci\u00f3n, p\u00e9rdida o alteraci\u00f3n accidental o il\u00edcita de datos personales transmitidos, conservados o tratados de otra forma, o la comunicaci\u00f3n o acceso no autorizados a dichos datos.<\/p>\n<p>Sin embargo, debido a que&nbsp;Serverus Tech Solutions&nbsp;no puede garantizar la inexpugnabilidad de internet ni la ausencia total de hackers u otros que accedan de modo fraudulento a los datos personales, el Responsable del tratamiento se compromete a comunicar al Usuario sin dilaci\u00f3n indebida cuando ocurra una violaci\u00f3n de la seguridad de los datos personales que sea probable que entra\u00f1e un alto riesgo para los derechos y libertades de las personas f\u00edsicas. Siguiendo lo establecido en el art\u00edculo 4 del RGPD, se entiende por violaci\u00f3n de la seguridad de los datos personales toda violaci\u00f3n de la seguridad que ocasione la destrucci\u00f3n, p\u00e9rdida o alteraci\u00f3n accidental o il\u00edcita de datos personales transmitidos, conservados o tratados de otra forma, o la comunicaci\u00f3n o acceso no autorizados a dichos datos.<\/p>\n<p>Personal data will be treated as confidential by the Data Controller, who undertakes to inform and to ensure by means of a legal or contractual obligation that such confidentiality is respected by its employees, associates, and any person to whom it makes the information accessible.<\/p>\n<h4>Rights deriving from the processing of personal data<\/h4>\n<p>El Usuario tiene sobre&nbsp;Serverus Tech Solutions&nbsp;y podr\u00e1, por tanto, ejercer frente al Responsable del tratamiento los siguientes derechos reconocidos en el RGPD y la Ley Org\u00e1nica 3\/2018, de 5 de diciembre, de Protecci\u00f3n de Datos Personales y garant\u00eda de los derechos digitales:<\/p>\n<ul>\n<li><i>Right of access:<\/i>&nbsp;Es el derecho del Usuario a obtener confirmaci\u00f3n de si&nbsp;Serverus Tech Solutions&nbsp;est\u00e1 tratando o no sus datos personales y, en caso afirmativo, obtener informaci\u00f3n sobre sus datos concretos de car\u00e1cter personal y del tratamiento que&nbsp;Serverus Tech Solutions&nbsp;haya realizado o realice, as\u00ed como, entre otra, de la informaci\u00f3n disponible sobre el origen de dichos datos y los destinatarios de las comunicaciones realizadas o previstas de los mismos.<\/li>\n<li><i>Right of rectification:<\/i>&nbsp;It is the User's right to have his\/her personal data that proves to be inaccurate or, taking into account the purposes of the processing, incomplete, modified.<\/li>\n<li><i>Right of deletion (\"the right to be forgotten\"):<\/i>&nbsp;This is the User's right, unless otherwise provided by law, to obtain the deletion of his\/her personal data when they are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn his\/her consent to the processing and there is no other legal basis for the processing; the User objects to the processing and there is no other legitimate reason to continue the processing; the personal data have been processed unlawfully; the personal data must be deleted in compliance with a legal obligation; or the personal data have been obtained as a result of a direct offer of information society services to a minor under 14 years of age. In addition to deleting the data, the Controller, taking into account the technology available and the cost of its implementation, shall take reasonable steps to inform controllers who are processing the personal data of the data subject's request for the deletion of any link to such personal data.<\/li>\n<li><i>Right to limitation of processing:<\/i>&nbsp;It is the User's right to limit the processing of his\/her personal data. The User has the right to obtain the limitation of the processing when he\/she contests the accuracy of his\/her personal data; the processing is unlawful; the Controller no longer needs the personal data, but the User needs it to make claims; and when the User has objected to the processing.<\/li>\n<li><i>Right to data portability:<\/i>&nbsp;In the event that the processing is carried out by automated means, the User shall have the right to receive from the Controller his or her personal data in a structured, commonly used and machine-readable format, and to transmit it to another controller. In cases where representation is admitted, it will also be necessary the identification by the same means of the person representing the User, as well as the document proving the representation. In the case of Spain, the supervisory authority is the Spanish Data Protection Agency (https:\/\/www.aepd.es\/).<\/p>\n<h3>II.
